The laws on sex work in England and Wales are due to change. Having gone through parliament, the lords and given the Royal Seal of approval, there is still a wait while the logistics of implementing the laws are thought through. Will there be enough time before the general election.

Law on trafficked prostitutes in force 'within months'

A new law that criminalises people who pay for sex with trafficked prostitutes may be brought into force "within months".

Home Office minister Alan Campbell told the joint committee on human rights that the police and Crown Prosecution Service (CPS) are "working closely" to ensure the law "is usable and will get convictions".

He said there may be a high-profile advertising campaign to "send out the message" about this new strict liability offence, which formed part of the Policing and Crime Act 2009.

I hope so too, because there is so much ignorance of the laws on prostitution. A very select selection of evidence was presented. The majority view of evidence that supported decriminalisation was purposefully left out by the Government. Even research commissioned by the Government which went against the Governments views appeared after the law had gone through the third reading. No wonder the country is so fed up with the manipulation of statistics by Government, and the total lack of honesty in discussing the opinions of the experts in the field.

Fiona Mactaggart (Lab, Slough) asked if the impending election could impact on the roll-out of an advertising campaign about the new law.

Campbell said he is "not enormously confident" that the law will come into force before the election, which must be held by June.

"We are heading towards purdah," he said, a reference to the consciously non-partisan stance taken by civil servants in the run up to an election.

This is an interesting comment, Campbell appears to believe the law may not be implemented by the time the election is held. What happens in this case, does the next parliament then implement the law, or can it just be forgotten.

The minister said chief police officers and the CPS will be consulted about how best to target a campaign, such as placing adverts in men's toilets at service stations.

Others do not realise they have rights as a trafficked person or develop 'Stockholm syndrome' and come to relate to their captors.

Many victims don’t realise their rights, and many victims can also be here illegally and with the inevitable fear of the authorities will not admit to be coerced. So many victims are just bundled up and sent back to their homes on immigration charges.

Dismore asked about the Olympics and prostitution.

Campbell said there is "an assumption" that there will be an increase in prostitution around a major sporting event such as the Olympics, but many of those women may come from surrounding areas and are not necessarily trafficked.

Fight the Britsh Law change on Prostitution

Let me tell you about the laws as they are now: selling sex in England and Wales is legal, but the associated activities are not. For example, ‘causing’ or ‘inciting’ prostitution is illegal. Loitering on the street, soliciting basically, is illegal too. So is running a brothel and persistent kerb-crawling. Wiki has a useful page if you want a bit more info. These laws as they are far from ideal; a look back at the attacks of sex workers in England reported in the media this year alone very clearly demonstrate their vulnerability -

In February, Steve Wright was found guilty of murdering Tania Nicol, Gemma Adams, Anneli Alderton, Paula Clennell and Annette Nicholls, sex workers working in Ipswich in 2006. Also that month, two men raped a sex worker in Swindon.
In April, a man is alleged to have raped a sex worker working in Nottingham, England, The Bradford News reports a sex worker was allegedly raped in Leeds and a man was jailed for raping a sex worker in Manchester back in January 2007.
In June, a court heard that a sex worker working in Liverpool
was raped at knife point in 2007.
In July, a court heard how a sex worker was raped after a client refused to pay in Bolton.
In August, a court heard that a sex worker was allegedly raped in Bristol back in November 2007, and Lubomir Kora went on trial accused of being part of a rape gang which was responsible for five attacks on Bradford (England) sex workers.
In September, a sex worker was raped at knife point in Preston.
In October, a man was sentenced to life for the rape and assault of a sex worker working in Northamptonshire, England. He is still being investigated by Northamptonshire Police for similar attacks on prostitutes in that area.
In November, West Yorkshire Police pleaded for information after two sex workers in Leeds were raped. It is not known if these incidents are linked.

These are the cases that made it to court and the papers, God knows how many attacks happen that don’t even make it to the police station. Clearly, there is a group of women in society that are being completely and utterly let down by the law.

And it’s set to get worse.

Home Secretary Jacqui Smith proposes to introduce new legislation that will give councils the power to close down brothels, “name and shame” clients, outlaw paying for sex with someone controlled for another’s gain and make kerb-crawling punishable as a first offense.

There are also other MPs who have expressed their doubt. The Liberal Democrat’s Shadow Home Secretary Chris Huhne believes,

The proposal to close brothels runs the risk of driving already vulnerable women underground and into the hands of pimps and pushers.

Dominic Grieve, Shadow Home Secretary for the Conservatives, says -

Yet again, the Home Secretary’s rhetoric is defied by reality. The Government wants to rush through new criminal laws without any consideration as to whether they will work.

In the meantime, it neglects the basics of law enforcement – funding for the Met’s human trafficking unit has been slashed, whilst the conviction rate for trafficking for sexual exploitation has plummeted.

And if I may quote Grieve further,

Take the blight of those trafficked into forced prostitution.

Last week Jacqui Smith proposed yet another law. But what has she actually been doing about the problem?

Upper estimates of the number of women and girls trafficked into Britain for prostitution have quadrupled on her watch.

And convictions of those who perpetrate these barbaric crimes are down by 40%.

Swedish model? Not working out so well. The danger that prostitution may be pushed underground is real and it’s effects are seen in Scotland and Sweden.

The advantages of decriminalisation are shown in New Zealand (h/t to
HangBitch). It would seem logical to talk about what is most advantageous to sex workers. We talk about definitions, semantics. “Sex worker” or “prostitute”.

Is it work? We talk about the ickiness of prostitution as though that justifies all these crimes against women. We debate the morality of it, is it right to sell sex? We place ideology above the safety of these women. We don’t question ourselves. UK radical feminists do not read that which disagrees with them (from blogland to parliament, who has been listening to the sex workers themselves?). Why not do all that after we’ve supported women’s rights not to be raped and assaulted?

Back to Jacqui Smith and how to stop her proposals getting through parliament. Well, now the Bill is drafted there will be readings in parliament so that every single word of the Bill is agreed. The second reading will be on the 12th January and we need to get as many MPs as possible to speak out against these changes. If you are concerned about these changes then I would urge you to write to your MP, or if you’re not in the UK, if you could pass this on, blog it, post it on your website, whatever to encourage your British readers to write to their MPs. I am writing to you as a resident of your constituency who is (a concerned member of the public)involved in the sex industry. The Policing and Crime Bill, that has its second reading on 12 January, contains proposals which will make people in the sex industry less safe and increase our social exclusion. The proposals make it more likely that street sex workers will be forced to work in greater isolation and as a consequence be hurt and killed, and less likely that victims of trafficking will come to the attention of the police. The proposals directly play into the hands of exploitative and violent criminals and traffickers by decreasing the ways to work safely and making sex workers less likely to call the police if they are the victims of crime and abuse.

The Home Office has failed to consult with sex workers’ organizations during the preparation of legislation (neither the International Union of Sex Workers or the English Collective of Prostitutes are considered to be stakeholders on this issue according to the Home Office report on Tackling the Demand for Prostitution of November 2008; neither is the UK Network of Sex Work Projects which provides frontline health and support services to people in the sex industry through 63 projects across the UK).

In addition, the proposals completely ignore an enormous range of academic research which shows that increased criminalisation has a negative effect: we need evidence based policy to create effective change and protect the vulnerable. The magnitude of the Home Office’s misinterpretation of evidence is shown in the Regulatory Impact Assessments associated with the Bill, which state that Pentameter 2 (a nationwide police operation) identified 800 brothels containing trafficked women. In fact, the police’s own figures for Pentameter 2 show raids on 822 premises located 250 victims of trafficking: the Home Office has confused the number of premises raided with the number of actual victims found.

I ask you to condemn these proposals during the second reading debate, and call for policy on the sex industry to treat our safety and human rights as the highest priority. This can only be achieved by meaningful consultation with those most effected: we are the experts in our own lives.

Also, there is a petition that has gone up on Number10.gov.uk - to defer any bill on prostitution until after the next general election. Signing this would also be a good start to stopping Jacqui Smith’s proposals coming to fruition.

As the petition states, you must be a British citizen or resident to sign it. If you are, I would urge you very strongly to sign it. If you’re not, but you do support it, as before, please do spread the word.

Proposition K in San Francsco

I was always hopeful that Proposition K in San Francisco would succeed. This would have decriminalized sex work and allowed sex workers more protection from abuse. Unfortunately the police and mayor did not see it that way, and the residents of the city were not convinced. A great well fare opportunity has been lost.

San Francisco sex workers have lost out in this. I speak as someone who has visited SF, but lives in Edinburgh Scotland. In Edinburgh brothels are licensed by the Local Authority, they are visited by the local police and prostitution out reach workers.

The result is very little street prostitution in that city compared with Glasgow where the authorities close down and prosecute the brothel owners. There is very little abuse and trafficking. Where there is trafficking, its not in the licensed brothels but in unlicensed flats. These get raided and closed down and successful prosecutions brought against the abusers.

The brothels exist all over Edinburgh in the center and are discreet causing no disruption to residents or businesses. Street prostitution exists, but to a very small amount in the outskirts of the city.

Even in this almost ideal world, there are people out there trying to close this industry down. Why? It not harming anyone. It is consenting sex between two adults for a payment. The brothels are drug free, and trafficking free. If the women is trafficked by an outside agency (pimp boy friend), then the brothel owners and her co-workers will see this and report it. This trafficking does happen, and the ability of the other prostitutes to report the fears is a great safety net. Once all this becomes illegal you will see a horrific rise in abuse.

The Poppy Project is a well meaning charity in the UK which helps women who are victims of trafficking. They though are blatantly anti prostitution and seem to get the two confused. They appear to have been given a grant by the British Government to survey the brothels of London found through the papers.

Of course the research was flawed, interpretations of the data opinionated by a radical dislike prostitution and the hatred of men. No proper comparison of other methodologies, other than one side sniping at countries like Holland.

A recent comment in the Guardian Comment is free forum questions the way this survey was put together. See the post. Some well put together arguments by UK escorts who really cannot stand the comments made by the authors of the Big Brothel Survey. Read comments AnotherEscort, who I can guarantee is a women sex worker.

My own comments come from letters I have written to my MP, and to information I have received from Scotland. This is what I wrote.

The Poppy project does a good job in helping trafficked women. Could not the Government have funded more places rather than funding some rather poor research.

Would the Government fund similar research by organizations who work with prostitutes like Scotpep (OK problem its Scotland, and a different Government), or someone like Julia O'Connell Davidson. I some how think not, they will not get the answer they want.

What also irritates me is the lack of openness? The Mori poll, all I have seen is a few quotes from the poll, all with rather loaded questions. Where is the full unedited Mori Poll as a tax payer I have paid for.

The figures from Pentameter don't stack up very well in the support for trafficking as was pointed out in an article by Julia O'Connell Davidson. Her comments were made after MacShane's lie in parliament of 25,000 sex slaves.

When 515 indoor prostitution establishments were raided by police as part of Operation Pentameter last year, only 84 women and girls who conformed to police and immigration officers' understanding of the term "victim of trafficking" were "rescued". At this rate, the police would need to raid some 150,000 indoor prostitution establishments to unearth MacShane's 25,000 sex slaves.

The figures for Pentameter 2 don't show much more of a problem, and remember unlike the Big Brothel project, Pentameter 2 was targeting locations where human trafficking was expected.

Pentameter 2 was a multi-agency operation, led by the police. It aimed to combat human trafficking for sexual exploitation by arresting, identifying, disrupting and bringing to justice those involved in this criminal activity. The operation succeeded in recovering 167 victims and made 528 arrests. It involved visits to 822 premises, the vast majority of which - 582 - were residential; 157 were massage parlours/saunas and the rest comprised other venues such as ports and hotels.

What is not mentioned in this quote from a letter I received from the home office is the number of successful prosecutions.

Hansard does say 71 charged. 167 'victims' of which 48 were deported.

I thought we did not deport victims. So were they victims?

At the start I mentioned Scotpep. They work with prostitutes, and unlike the Poppy project survey which relied on phone calls and no visits (Have they not heard of high pitch sales men, with special offers that don't exist when you come to buy), the Scotpep workers speak to prostitutes. Thats their job. From a small research project they did amongst the Edinburgh brothels. I shall extract some snippets.

One sex worker identified herself as a lifelong feminist and said Defining prostitution per se as violence against women, as several abolitionists have done, is patronising and misogynistic.

How do you feel about your involvement in prostitution?

Some said that they enjoyed the sex; one said that she did not experience sexual pleasure in her work, but that this absence did not bother her.

. One said that she felt empowered and was in control of both her finances and sexuality.

Another said she had never felt exploited by any customer or boss, and that while some customers could be very nice and others not so nice, this was true of any job which involves dealing with the public. This sentiment was echoed by another sex worker who stressed that she had always preserved her own boundaries and never done anything she wasnt comfortable with, preferring to lose money than be ill-treated or feel dehumanised or degraded.

Conclusions

It is always a concern when someone does not choose sex work of their own free will, whether because another person has forced them into it or because they feel there is no alternative way to address their financial needs or problems. As such, the fact that only a small minority of respondents to this survey expressed such feelings should not be glossed over. On the other hand, it would be dishonest to seize upon their answers and hold them up as representative of most workers in Edinburghs sex industry. Instead, it must be understood that an individuals experience is representative of nobody but themselves. Prostitution is not inherently violent and abusive; nor is it inherently empowering. Different people may experience it as either or both of these things, or as something else entirely. Prostitution is inherently nothing but the exchange of sexual services for money. What matters is that we listen to sex workers voices instead of putting words into their mouths. To protect sex workers from harm, we must meet the needs that they themselves identify, rather than impose assumptions onto their experience.

Glasgow takes the anti prostitution stance again

I saw this report in the Scotsman. Those who rule the city of Glasgow again stand up for a zero tolerance of prostitution in Glasgow. They have petitioned the government asking for the criminalisation of the purchase of sex.

That city Glasgow has been a failure when it comes to sex work. Their zero tolerance of saunas and brothels has resulted in a greater proportion of women working the streets than in neighbouring cities of Edinburgh and the far North Aberdeen. Edinburgh has virtually legalised brothels, calling them saunas, while Aberdeen tries to get the women to work in pairs in flats. Glasgow has seen many horrific murders and assaults on sex workers. When will they ever learn and accept that safe working conditions in brothels is a far better place for women to work.

ScotPEP has released figures showing that the number of attacks on prostitutes has doubled since 2006.

Hello and welcome to my first post on my new blog. Why have I started to blog my exploits in buying sexual services from prostitutes (I will never use that word again)?
